My Lawyer Made Me Plead Guilty
A man points a gun at an officer, struggles with him, bites him on the hand and is arrested. He was stopped for an allegation of aggravated indecent assault. He claims that since he still owes his lawyers $15,000 out of a $25,000 retainer, his lawyers pressure him to plead guilty on the night before trial and the next day he does. He appeals his case he is given a new trial.
Unfortunately we don’t know what evidence the prosecution had on this guy. Clearly they had the officer who would testify that this guy pointed a gun at him. Should he have gotten a new trial? In my state, this person most likely would not get a new trial.
